Zoners To Look At Car Dealer's Variance

Warsaw could have another pre-owned car dealership if a variance of use is approved tonight.

The Warsaw Board of Zoning Appeals will review a variance of use to permit retail and automobile sales at 740 W. Winona Avenue. Applicant Donald Bays, doing business as Tri Lakes Auction, is requesting the variance for retail and automobile sales.

The applicant recently purchased the property, which includes eight lots and access to the property from Winona Avenue and Jefferson Street.

The applicant has proposed to sell pre-owned cars and new miscellaneous merchandise. The cars will be located outside of the building and the miscellaneous merchandise will be inside.

The applicant is expecting to have three employees, including himself and two family members. The parking lot is currently gravel and six new dusk-to-dawn lights have been installed.

The hours of operation would be 9 a.m. to 5 p.m. Monday through Saturday, with auctions periodically in the evenings beginning at 7 p.m. until the merchandise is sold.

The board also will review two proposed variances from development standards for a fence and deck to be built at 5 Miner Drive.

Applicants Brian and Madeline Marquardt are requesting a variance from development standards to erect a 6-foot high three-rail flat-top fence with the required 10-foot front yard setback of the property.

The petitioners also are requesting a variance from development standards to erect a deck within 14 feet of the required 25-foot front yard setback.

The board will meet tonight at 7 p.m. at city hall.
