Zoners Continue Wawasee Airport's Sell-Off

Posted

Once again, Wawasee Airport's petition for a variance to permit allowing an additional sell-off was continued by the Kosciusko County Board of Zoning Appeals Tuesday.

The airport did not get all the information to the technical committee of the BZA in time for the committee to review the case. The petition will be revisited at the Jan. 13 BZA meeting.

The property is on the south side of CR 1290N and zero feet east of Bishop Road in Turkey Creek Township.

In Chapman Lake, three persons with sheds next door to each other each petitioned the BZA for variances for their sheds. The BZA told each petitioner they'd have to relocate their sheds at least 5 feet from the property line.

Petitioners in the matter include: Doris Moody, variance to permit a shed to be moved from its current location 14 feet from the right of way and extend the overhang on the end of the garage, property on south side of EMS C27C Lane and 190 feet east of EMS C27C1 Lane, Plain Township; Jenny Lozano, variance to permit a 12-foot by 16-foot shed to remain as placed zero feet from the right of way and 3.2 feet from the east property line, south side of EMS C27C Lane and 150 feet east of EMS C27C1 Lane, Plain Township; John Rees, variance to permit allowing an existing shed to remain as placed zero feet from the road right of way and one foot from the west property line, property is on the southeast side of EMS C27C Lane and 215 feet northeast of EMS C27C1 Lane, Plain Township.

Mike DeWitt's petition for an exception to change a previously granted exception to allow the expansion of a car lot and to allow a nonconforming residence to be separated off using a pre-existing easement in an industrial 2 district was granted, with a condition. The condition is that all documents regarding the vacation of an existing private easement and the re-establishment of access to a house have to be recorded before the exception is officially approved.

Both Tom Gaither's and John Quake's petitions for variances were continued. The board wanted comment from the private property association of the subdivision.

Gaither's variance would permit the construction of a residence 20 feet from the east right of way and 20 feet from the west water's edge. The property is on the west side of vacated Mariposa Drive and 270 feet north of Cherokee Road in Turkey Creek Township.

Quake's petition for a variance would permit the construction of a residence 20 feet from the east right of way and 20 feet from the west water's edge. The property is on the west side of vacated Mariposa Drive and zero feet north of Cherokee Road in Turkey Creek Township.

Of all the petitions brought before the BZA Tuesday, three were outright denied, including:

• William Rigel's petition for an exception for the change and alteration of a nonconforming residence by allowing a tract to be separated to allow a new residence to be constructed in a residential district. The property is on the north side of Asbury Lane and zero feet south of Epworth Forest Road in Tippecanoe Township.

• Rex Sparks' petition for an exception to allow a duplex on a tract of agricultural ground. The property is on the west side of CR 875W and 172 feet south of Old Road 30, Etna Township.

Approximately seven people spoke against the request, and a petition against Sparks with approximately 23 signatures was presented.

• Scott Gunder's petition for a variance to permit the construction of a residence addition 26 feet from the southwest road right of way. The property is on the southeast side of Lantern Road and zero feet northeast of Westerner Winds Drive in Plain Township.

In other petitions, the BZA approved:

• Steven Kelly's petition for an exception to allow an addition on an existing oversized accessory structure in a residential district. The property is on the north and west side of Turkey Creek Road and 930 feet south of CR 1050N in Turkey Creek Township.

• David Gerwells' petition for a variance to permit a residence addition to remain 23 feet from the road right of way. The property is on the east side of EMS D23 Lane and 200 feet north of EMS D24 Lane, Van Buren Township.

• Darwin Sievers' petition for a variance to permit a shed to remain 18 feet from the road right of way and 7-1/2 feet from the south property line. Sievers actually petitioned to keep the shed at one foot from the road and three feet from the south property line. The property is on the east side of EMS B61I Lane and 640 feet south of EMS B61I1 Lane, Tippecanoe Township.

• Aaron Jay Miller's petition for a variance to permit the construction of a residence on a tract with an existing residence then to allow the old residence to remain as a rental and construct an ag accessory in the future. The property is on the west side of CR 800W and 880 feet north of CR 750N in Etna Township. The BZA put a condition on the approval that the second residence can only be occupied by family.

A total of 23 petitions came before the BZA Tuesday.

Members of the BZA are Vic Virgil, Charlie Haffner, Bob Beer, Walter Church and John Conley. They meet at 8:30 a.m. on the second Tuesday of every month in the Justice Building meeting room, Warsaw.
