A domestic dispute Monday could result in battery charges being brought against a former Kosciusko County deputy prosecutor by his ex-girlfriend.
Kosciusko County Sheriff's Dept. deputies were called to a residence at 1759 E. Springfield Drive, Warsaw, just after 10 p.m. Monday.
A 38-year-old Warsaw woman told deputies she had moved out of the Springfield Road address, owned by Scott Smith, five months ago.
Smith was a deputy prosecutor in 2003 and 2004 in Kosciusko County.
The woman said she and Smith had been at Buffalo Wild Wings earlier in the evening, but she left to retrieve personal items and Christmas presents for her kids. She wanted to get the items before Smith returned, according to the police report.
She told deputies that when Smith did finally arrive home, she told him that she was getting her stuff and was leaving. Smith allegedly told her that it was his house and she was not leaving. Smith then allegedly pushed her to the floor of the second story foyer, according to the report.
The woman then ran from the house, locked herself in her car and called 911.
In speaking with deputies, the woman detailed an incident in which she says Smith threw an iron at her, struck her in the eye, and she received a concussion. That incident happened in New York and Helser spent the night in the hospital because of it.
According to the police report, she also stated that two months ago, Smith broke her nose when she got too close while he was throwing punches in the air.
the woman works for Smith and has never before pursued any charges against him because she feared she would lose her job.
When confronted by Deputy Brandon Hepler about filling out a report about the incident, Smith said he would not do so because he's done nothing wrong, and that he's never laid a hand on her.
When he was advised that the woman wanted to pursue charges and a copy of the incident report would be sent to the prosecutor's office, Smith allegedly said that the prosecutor knows who he is and would do nothing about it.
There is no further information at this time, but the incident remains under investigation.
