A Warsaw man arrested in April of 2012 on a count of sexual misconduct with a minor pleaded guilty to a lesser charge of sexual battery in court this morning. As a part of his plea agreement, Gary W. Golday, 44 at the time of the incident, now 46, Warsaw, entered a plea of guilty to the charge of sexual battery – Class D felony. In exchange, the court dismissed the count of sexual misconduct with a minor. According to an affidavit filed by the Kosciusko County Prosecutor’s Office, in August of 2011, a female victim who was 15 years old at the time of the incident told police she had been staying the night with Golday’s daughters when the man allegedly woke her up, took her to his bedroom and raped her. She advised he forced her to smoke marijuana and drink vodka, then removed her clothing and his own, performing sex acts and raping her. The victim was taken to Kosciusko Community Hospital for a sex crime evaluation and drug screening. A DNA swab taken off the victim’s body showed that Golday could not be ruled out as the contributor and the drug screen showed the victim had been exposed to marijuana. Golday denied the rape claim but told police he had woke during the night to find the victim on top of him and kissing him. He advised he stopped kissing her and asked her to leave. Golday was arrested on the preliminary charge of sexual misconduct with a minor in April of 2012, though his guilty plea was entered for the lesser charge of sexual battery. If convicted, Golday could face between six months and three years in prison and fines of up to $10,000. Sentencing is set for Jan. 8 in Superior Court I.
