A Warsaw man arrested in July on a felony and misdemeanor count of domestic battery and for battery resulting in bodily injury against a pregnant woman pleaded guilty this morning to a charge of domestic battery in the presence of a child less than 16 years old. As a part of his plea agreement, Jacob I. Hamilton, 20 at the time of the incident, Warsaw, entered a plea of guilty to the charge of domestic battery in the presence of a child less than 16 years old – Class D felony. In exchange, the court dismissed the misdemeanor battery charge and the felony charge of battery resulting in bodily injury against a pregnant woman. According to police reports, Hamilton met with the victim at her work shortly after midnight July 2. On the drive home, he requested she stop and purchase alcohol for him. When the victim refused, Hamilton became angry, throwing items in the vehicle. When they arrived home, the victim attempted to remove an infant child from the vehicle when Hamilton began kicking the vehicle. The victim asked Hamilton to leave when he allegedly threw her onto the ground and began stepping on her head. Hamilton then allegedly began pressing on her eyes with his thumbs. The victim, who was pregnant at the time of the incident, managed to escape and avoided further injury. If convicted of the charge of battery in the presence of a child less than 16 years old, Hamilton could face between six months and three years in prison and up to $10,000 in fines. Sentencing is set for 8:30 a.m. Jan. 8 in Superior Court I.
