Warsaw Home In Foreclosure, Former Owner No Longer Required To Pay Civil Penalty

A former Warsaw property owner no longer has a civil penalty ordered against him for a property the city has deemed unsafe. During a hearing April 20, Hearing Officer Lawrence Clifford ordered a $2,500 penalty against Phil Smith, who previously occupied the home at 108 N. Park Ave. The home is now vacant. A demolition order also was going to be reviewed by the city. The city had received complaints about the home having boarded-up windows, exposed framing, a dilapidated rear porch and no siding, as well as being unsecured. Electrical service to the home has been disconnected. Todd Slabaugh, building commissioner, said he drove by the home Wednesday and a property restoration company was there and informed him the home is foreclosed and the bank owns the home. “A property restoration company is not at a home until the property has been foreclosed,” Slabaugh said. Slabaugh said he will need to research who holds the mortgage on the home. A hearing on the property will be May 18 at city hall at 1:30 p.m.
