Titus Attorney Offers Response To Complaint

A Plymouth attorney represnting Titus Funeral Home offered a copy of a response to allegations of violating state code.

Rick Huff offered a response to a complaint filed by the state attorney general's office stating that Jerry Titus, Titus Funeral Home Director, failed to transfer pre-arranged funeral information.The complaint states that six different people requested the transfer of pre-paid funeral arrangements from Titus Funeral Home to Redpath-Fruth Funeral Home.

In all six instances, the people's requests hadn't been fulfilled months later.

The complaint states that not transferring the files within 30 days was a violation of state code.

In the response, Titus claims that "the large number of requests led them to suspect Ron (Redpath), John (Fruth) and/or Pat (Redpath) had taken Titus' list of pre-arrangements."

The response claims that Redpath-Fruth tried to solicit signatures to transfer funeral arrangements and cited that most of the clients are "elderly and in ill health."

Despite the Titus' response, the complaint by the attorney genral's office asks the State Board of Funeral and Cemetery Services to issue a judgment against Titus.

If a judgement is issued against Titus, the disciplinary action could range from a letter of reprimand to the permanent loss of a license.

This is the first complaint against Titus.

A settlement conference is set for Dec. 4 with the Indiana State Board Of Funeral Directors. If no settlement is reached, the matter goes to the board's Feb. 5 meeting.
