Like several other bars and restaurants in Warsaw, Bennigan's Restaurant, East Center Street, Warsaw, was serving alcohol the day of the special school board election Feb. 8.

Shamrock Management Group of Elkhart operates Bennigan's. The company's representative, Mike Briski, complained to alcoholic beverage board members Thursday about the lack of notice for the special election. He said he had no idea Bennigan's was in the specified precinct.

The legal notice for the special election in Precinct 1, Ward 2 was published Feb. 3 in the Times-Union. State statute, IC 3-10-8-4(b), calls for publication no later than 30 days before the election.

Bennigan's has been fined

$250 for the election-day violation as well as another $250 for failure to produce a bartender's license for an employee who served alcohol.

Commissioner Gordon Vanator advised Briski to contact excise officer Patty Fleck, who was absent from the meeting. Bennigan's permit renewal was tabled.
