Suspect Shot In Confrontation With Officer After Taser FailsA man was shot in the arm Wednesday evening by a Warsaw Police Department officer after a brief confrontation.

Kosciusko County Central Dispatch received a call at 5:28 p.m. Wednesday regarding an unwanted person in the 1800 block of Michaels Street. WPD Officer Daniel Clemens responded to the call.

The person – identified as Kyle Miller, 31, Warsaw – was reported to have been unknown to the residents of the house, according to a news release from the Indiana State Police, which is investigating the matter. Miller left prior to the police arriving and began to walk in traffic on Old 30, also known as Lake Street. He then allegedly began to try to get into cars that were passing by and was stopped by Clemens.

During the encounter, Miller began to struggle Clemens, who attempted to use his Taser, the release states. The stun gun had no effect on Miller. As the encounter continued, Clemens fired his weapon, hitting Miller in the right arm, and the suspect received non-life-threatening injuries.

Once the scene was stabilized, officers rendered aid to Miller prior to Lutheran EMS arriving.





Contrary to early rumors, a UPS driver was not involved in the struggle or shooting. ISP Public Information Officer Sgt. Ted Bohner said the driver was a witness and that only Miller was shot.

Miller was arrested and booked into the Kosciusko County Jail at 10:09 p.m. Wednesday for resisting law enforcement. His preliminary bond was set at $5,250. His booking information listed his address as homeless.

Miller was arrested earlier this month for possession of methamphetamine, a level 6 felony, and possession of paraphernalia, a Class C misdemeanor. Along with prior drug-related convictions, he was found guilty of false informing in a 2013 case in which he also had been charged with resisting law enforcement.

Clemens was not injured. He has been a member of the Warsaw Police Department since December. Clemens is currently on paid administrative leave per the policy of the WPD.

At the conclusion of the ISP investigation, all findings will be turned over to the WPD and the Kosciusko County Prosecutor’s Office.
