Suit Alleges Faulty Implant

Posted

DePuy Inc. is being sued for an unspecified sum of money after a prosthetic hip broke inside a man's body, causing an infection and resulting in three additional hip surgeries, a lawsuit claims.

Ron Leonard, Fort Wayne, reportedly underwent the initial surgery in May 2002. In April 2003, after learning the prosthesis was faulty, he underwent a second surgery to replace the broken parts.

The second surgery resulted in an infection, making the new prosthesis fail and causing him to undergo two additional surgeries.

The lawsuit alleges that the prosthetic hip was defective when it was sold by DePuy and that the harm it caused was or should have been forseeable by the company. It also claims DePuy was negligent in its manufacturing of the prostheses and that they breached an implied warranty selling an allegedly faulty product.

DePuy representative Mark Piazza was not able to comment, as the case is currently in litigation.
