Dr. Dane Miller has another attorney to add to his team of attorneys in his suit against former partner at Winona Restoration Partners Brent Wilcoxson. On Tuesday, John D. Ulmer, of Yoder, Ainlay, Ulmer & Buckingham in Goshen, filed his appearance as an attorney for Miller. Miller currently has two other attorneys on his team, Michael W. Reed, of Reed and Earhart, Warsaw, and R.C. Richmond, of Taft, Stettinius & Hollister, Indianapolis. On July 19, Special Judge Terry Shewmaker, of the Elkhart County Circuit Court, officially accepted the bid to be the special judge in the suit. A week-and-a-half after Shewmaker, an Elkhart judge, took over the case, Miller hired a local attorney to help with the suit. Ulmer would not comment on the timing of his firm being hired to represent Miller. A status conference meeting regarding the lawsuit is scheduled for Aug. 17 at 8:30 a.m. where all parties will discuss the case. Miller, co-founder of Biomet, filed a lawsuit against Wilcoxson, the former executive of the Village At Winona, June 29. The lawsuit alleges Wilcoxson took property from WRP and transfered it to Wilcoxson’s own not-for-profit company, Winona Arts Restoration and Preservation. Miller also alleges several monetary improprieties while Wilcoxson was the head of WRP.
