Marijuana Arrest Near School in Milford

MILFORD – A Milford man was arrested Tuesday evening at a gas station parking lot after police found pot inside his vehicle.

Milford police officers Rich Miotto Sr. and Tim Miller responded to an anonymous tip Wednesday evening at approximately 5 p.m. regarding a subject possibly dealing marijuana from his vehicle.

Officers arrived at the Milford Stop and Go gas station on Ind. 15 at Emeline Street and located the described vehicle.

Zachary Dale Smith, 21, of 508 W. Catherine St., Milford, was asked to exit his vehicle where officers located marijuana and several paraphernalia items.

Smith was subsequently arrested and preliminary charged with possession of marijuana. A juvenile also was located in the vehicle and was taken into custody but later released to the custody of his parents.

Town Marshal Richard Miotto advised that the incident also is being forwarded to the Kosciusko County Prosecutor’s Office for review.

The location of the arrest is within 1,000 feet of a school or day care, which could elevate the charges to a felony status. Smith is still in the Kosciusko County Jail with a $450 bond as of press time.
