John Ciacca was in court this morning for a plea hearing in connection to an October incident where he allegedly ran over a man with a car.
Ciacca, 32, of 1964 Northbrook Blvd., Warsaw, pleaded guilty to battery causing serious bodily injury, a Class C felony. As per the terms of the plea agreement, there is no limit on the period of incarceration and Ciacca is ordered to not have contact with the victim.
Kosciusko County Superior Court I Judge Duane Huffer took the plea under advisement and ordered a pre-sentence investigation report to be completed by the probation department. The plea acceptance hearing is slated for March 14.
On Oct. 19, 2011, Ciacca was booked into the Kosciusko County Jail on preliminary charges of aggravated battery, a Class B felony, and no bond was set.
According to a report from the Warsaw Police Department, Ciacca and a woman he had dated were arguing while she was on the phone with the victim, before the incident. The victim heard the argument and walked down the street to check on the woman.
At some point after the argument, Kosciusko County Sheriff’s Department deputy Jeff Howie was taking out his trash when he witnessed Ciacca run over the victim in the alley behind the 700 block of East Main Street. Howie arrested Ciacca at the scene. The woman Ciacca argued with witnessed the incident as well.
If Huffer accepts the plea agreement, Ciacca could face between two to eight years in prison. The advisory sentence is four years.
