Man Charged with Prescription Fraud Receives Probation

The man who was responsible for attempting to obtain a controlled substance with a false prescription at a local pharmacy in 2011 was sentenced Nov. 1.

Thomas Calhoun, 29, South Bend, was sentenced to one and a half years in prison for attempting to acquire a controlled substance by fraud, a Class D felony. Kosciusko County Circuit Court Judge Rex Reed then suspended the sentence and ordered Calhoun to participate in probation for the length of his original sentence. While on probation Calhoun will be subject to random drug testing. Calhoun was also ordered to pay a fine in the amount of $100 and a drug interdiction fee of $200.

As per his plea deal that was signed on Jan. 5, the first count of forgery, a Class C felony, was dismissed by the court.  

On June 28, 2011 Calhoun entered the CVS in Warsaw and attempted to fill a prescription for a generic form of Oxycodone for his girlfriend, Jackayla Snodgrass. The pharmacist did not believe that the prescription was from Dr. Darr, of Provident Family Healthcare.  When the pharmacist began to question the prescription Calhoun fled.

Prescription pads from Dr. Darr’s office were used in Kosciusko and St. Joesph counties to fill false prescriptions, police found through subsequent investigation.

Snodgrass was sentenced on Sept. 20 to one and a half years probation on a suspended sentence in Reed’s court. Snodgrass also had the first count of forgery, a Class C felony, dismissed.
