A civil plenary was filed against Beef-A-Roo in Kosciusko County, alleging the business defaulted on rent and failed to pay utilities and maintain insurance at their former Detroit Street location.
In the suit filed Aug. 6, 408 N. Detroit St. LLC is listed as the plaintiff and is being represented by John Spencer Feighner, Haller & Colvin, PC, Fort Wayne. Beef-A-Roo Inc. and Rocinante Equity Inc., doing business as Elysian Capital Inc., are listed as the defendants.
408 N. Detroit St. LLC claims they and Beef-A-Roo fully executed a commercial lease on Sept. 23, 2024, for the rental of the 408 N. Detroit St., Warsaw, property. Both the plaintiff and Rocinante Equity executed a Corporate Guaranty Agreement, which would guarantee the payment and performance of all the obligations of Beef-A-Roo under the lease.
According to the lease, Beef-A-Roo is required to submit monthly rent to 408 N. Detroit St. LLC and Beef-A-Roo is also solely responsible for all real estate, property and other such tax assesments against the premises.
Beef-A-Roo failed to pay rent payments for May, June and July 2026. Upon information and belief, Beef-A-Roo has failed to pay utility payments for the premises and failed to maintain insurance, which it was obligated to do under the lease, according to the lawsuit.
On July 6, 2026, 408 N. Detroit St. LLC sent Beef-A-Roo a notice of default and demand letter addressing the outstanding rental payments and Beef-A-Roo’s default under the lease.
On July 29, 2026, the plaintiff sent Beef-A-Roo notice of exercise of its right to accelerate all amounts due, and to terminate the lease while reserving all rights and remedies held by the plaintiff.
Beef-A-Roo did not respond to any letters, phone calls or emails.
408 N. Detroit St. LLC is suing Beef-A-Roo and Rocinante Equity for breach and violation of the lease agreement and of the corporate guaranty agreement. 408 N. Detroit St. LLC is asking for the court to find in favor “against the defendant for all damages recoverable by landlord … award post-judgement interest at an annual rate of 8% until paid in full,” pay the 408 N. Detroit St. LLC’s attorney’s fees and all other costs incurred, and to put 408 N. Detroit St. LLC in immediate possession of the location.
According to ABC 57, Beef-A-Roo CEO Jeff Love and his companies, Beef-A-Roo and Elysian Capital, were summoned to Saint Joseph County Court in July; it was chosen as neutral ground for a hearing involving a lawsuit by a Beef-A-Roo landlord in Rockford, Ill., who says Love owes him over $600,000. But Love failed to appear, along with counsel.
