An initial hearing concerning a 12-year-old girl will be held Oct. 2.
In a hearing held Tuesday in Superior 1 Court, Chris Kehler, the attorney for Katherine Lantz, 12, entered a denial of the allegations.
According to a report from the Kosciusko County Sheriff's Department, Katherine Lantz, 12, of North Park Schramm Road, allegedly became incorrigible after being confronted by Boyd Miller, 74, North Park Schramm Road, Warsaw, for smoking cigarettes.
Lantz allegedly pushed Miller down, causing him to strike his head. Miller was paralyzed on his left side as a result of the injury, police reports indicate.
Miller was released from the hospital this week.
A story published in Wednesday's edition of the Times-Union stated the girl will be charged as an adult.
By law, a juvenile can't be tried as an adult unless paperwork is filed by the prosecutor's office. That has not happened in this case.
Lantz currently is being charged with a "delinquent act."
