Gun Incident Leads To Neglect Charges Against 28-Year-OldAfter a child fired a rifle in one trailer and the bullet went inside another trailer, the owner of the gun is facing neglect charges.

Kyle R. Wutcher, 28, Goshen, was booked into the Kosciusko County Jail at 9:59 a.m. Friday for neglect of a dependent. His bond was set at $10,000 surety and $250 cash.

Court documents filed Jan. 29 list his address as 920 Anchorage Road, lot 25, Warsaw, and the charges against him as dangerous control of a child, a level 5 felony, and neglect of a dependent, a level 6 felony.

On Jan. 5, Warsaw Police Department officer Jordan Roberts was dispatched to a residence in reference to shots fired. There, he was able to see a bullet hole in the kitchen wall; the bullet also traveled into the freezer.

The residence was occupied by two adults and three minor children when the bullet was fired. Roberts and other officers searched the area to find where the bullet was fired from, according to court documents.

While searching the area, Roberts was approached by Wutcher, who told Roberts that the bullet had been fired from his residence by a minor. Roberts went with Wutcher to his residence at lot 25 and was shown the firearm that was fired, a Mauser 95 7 mm rifle with an ammunition sleeve on the buttstock containing ammunition.

Wutcher told Roberts that he and his wife and daughter were watching television in the living room while another child was in a separate room where the gun was kept, with the door closed. Wutcher said the rifle was unloaded but the ammunition was kept in the closet where the gun was stored.

Wutcher said that the child found the rifle, loaded it and fired it while in the room with the door closed. The wife confirmed Wutcher’s story.

Wutcher said he had taken the child to a shooting range in the past and that the child would know how to load and unload the rifle.
