A Leesburg man this morning withdrew his original not guilty plea and entered a guilty plea on sexual misconduct charges, a level 6 felony, in Superior Court I. Theo Richard Timmerman II, 21, of 5219 E. CR 500N, Leesburg, was arrested following an incident Nov. 13. An officer with the Kosciusko County Sheriff’s Department spoke to the victim’s father who said his 15-year-old daughter and Timmerman were having sexual intercourse. The officer also spoke to the victim and she admitted to having intercourse with Timmerman on multiple occasions, according to a probable cause affidavit filed by the Kosciusko County Prosecutor’s Office. The officer also spoke with Timmerman and Timmerman admitted the intercourse occurred on three different occasions. He said he had intercourse with her the first time and he thought she was 16, but after he discovered she was 15, they had intercourse two more times, the affidavit states. Superior Court I Judge David Cates said he could accept or reject the plea agreement filed by Timmerman and his attorney Jay Rigdon. A level 6 felony can carry the possibility of 1-1/2 to 2-1/2 years in prison and a fine of up to $10,000. According to the plea agreement, Timmerman is to have no contact with the victim, and Cates said Timmerman wil be responsible to pay restitution to the victim’s family for counseling. Timmerman’s plea acceptance and sentencing is scheduled for 9:30 a.m. June 25.
