Failure To Appear Leads To Warrant In Chicago Man’s Reckless Driving Case

A Michigan man and an Illinois man were taken to jail May 26 for racing their vehicles at 2:23 a.m. on Lake City Highway.

Now, one is wanted by the sheriff for failure to appear in court on the reckless driving charge.

Ismail Bin Mubarak, 18, Chicago, and Jahangir Alom, 21, Grand Rapids, Mich., were booked into the Kosciusko County Jail at 3:38 a.m.  May 26, for reckless driving, a class B misdemeanor. Bond was set for each at $500. Mubarak failed to appear Monday at his initial hearing in Superior Court II, and a warrant was issued for his arrest.

According to the probable cause affidavit, WPD officer Ross Minear was on patrol when he observed two eastbound Chevy Cruze vehicles traveling at a high rate of speed on Lake City Highway in the area of Old Road 30. Minear's radar indicated speeds of 93 miles per hour in the 45 mph zone, and he was unable to obtain a speed on the second vehicle because they were traveling so close together. Minear turned around in the median to try to catch the vehicles and passed a slower moving vehicle in the area of the Marathon gas station. At this point, his radar indicated the second vehicle was traveling at 92 mph, and they were now in the area of Hacienda, still in the 45 mph zone.

After successfully pulling both vehicles over, Alom told police the vehicle in front of them were their friends and they were traveling from Chicago to Fort Wayne.

A free air search of the vehicles resulted in a positive alert to the Michigan-plated vehicle, "but only some marijuana ‘shake,’ or very small pieces of marijuana, were located in the carpeting of the vehicle."

Police later learned the slower traveling vehicle Minear passed during pursuit, a Michigan-plated Honda Civic, was also a part of the group, although it was not observed traveling at a high rate of speed. Police allowed a passenger in Mubarak's car to phone the friends in the third vehicle to bring a licensed driver to the scene so the vehicles would not have to be towed. All three vehicles were driven away from the scene to avoid being towed.

According to the WPD report, a note of clarification in the investigation was added, stating: "I observed that all parties involved in had a birth dates that began with January 1st or 01/01, but with different birth years. All parties had valid identification cards or valid driver's licenses that correctly return though the states in which they were issued."

The bond for Mubarak's failure to appear warrant is set at $5,000 surety only.
