Elkhart Judge to Take Over Miller v. Wilcoxson

Posted
Attorneys for Brent Wilcoxson filed their motion to accept a special judge in the Dr. Dane Miller vs. Wilcoxson case.

On July 17, Elkhart County Circuit Court Judge Terry Shewmaker was appointed to take over the case for Kosciusko County Superior Court I Judge Duane Huffer.

On July 6, after the hearing on the temporary injunction, Huffer gave both parties a panel of names for special judges. Those judges included St. Joseph County Judge John Marnocha, Allen County Superior Court I Judge Nancy Eschoff Boyer or Elkhart County Judge Terry Shewmaker.

On July 16, the defense struck the names of Marnocha and Boyer and agreed to Shewmaker as the new judge.

Additionally, the defense filed a motion for an extension in order to reply to or plead to the charges that Miller alleges. The extension lasts until Aug. 18.

The next court date is Aug. 17 at 8:30 a.m. where all parties will have a telephone conference meeting on the status of the case.

Miller, co-founder of Biomet, filed a lawsuit against Wilcoxson, the former executive of the Village At Winona, June 29. The lawsuit alleges Wilcoxson took property from Winona Restoration Partners and transfered it to Wilcoxson’s own not-for-profit company, Winona Arts Restoration and Preservation. Miller also alleges several monetary improprieties while Wilcoxson was the head of WRP.

Miller's attorney had no comment when contacted this morning, while attempts to contact Wilcoxson’s attorney were unsuccessful by deadline today.
