A Kosciusko Circuit Court jury ruled against R.R. Donnelley & Sons recently in an eight-year $12.5-million lawsuit against North Texas Steel.
Donnelley initiated the suit against North Texas Steel Dec. 18, 1995, after metal shelving units purchased from the company collapsed, causing damage to Donnelley's product, the building, delivery vehicles, the fire sprinkler system and more.
Donnelley also suffered losses after the collapse, paying overtime to workers to reproduce lost product and repair and reconstruct damaged equipment, the suit claimed.
According to the lawsuit, the shelving units were not properly constructed and a warranty was breached when North Texas Steel failed to reimburse Donnelley for damages after the June 1994 collapse.
The trial, which began Sept. 30, resulted in a jury verdict that said, "The plaintiff, R.R. Donnelley & Sons Inc., takes nothing by its complaint."
A final judgment order from special Fulton County Judge Morton has yet to be filed.
