Davis Requests Jury Trial In Fatal Traffic Accident Case

ALBION - The case of a Warsaw man involved in a fatal traffic accident in 2010 continues in the Noble County court system.

Earlier this week, Samuel Davis, 35, of 3762 W. Old 30, Warsaw, requested a jury trial to be held in Noble County. Davis is charged with causing death when operating a motor vehicle with an ACE of +15, and two counts of causing death when operating a motor vehicle with a schedule I/II controlled substance in his system.

The charges are the result of an accident March 2, 2010, in which 22-year-old Victoria L. Anderson, Warsaw, was killed.

The fatal crash occurred around 4:23 a.m. when Davis' vehicle, which was westbound on Old 30, drove off the north side of the road and struck a tree. Davis was pinned behind the steering wheel and had to be extricated. Anderson suffered severe internal injuries and head trauma and was pronounced dead at the scene.

After being treated for his injuries in Fort Wayne, Davis was released. He was later arrested and booked into the Kosciusko County Jail on a $50,000 bond.

His case was moved on a change of venue from Kosciusko to Noble County in December, and through his attorney, he has requested a jury trial.Although the case is being tried in Noble County, the Noble County Prosecutor's Office is not involved. R. Steven Hearn, of the Kosciusko County Prosecutor's Office, has been named as special prosecutor.

The jury trial is scheduled to begin July 12.

Davis is currently being held in the Kosciusko County Jail.
