County Says CR 200N Repairs Are Contractor's Responsibility

If a person wants to complain about the condition of CR 200N, they shouldn't call the City of Warsaw or the Kosciusko County Highway Department.

According to Kosciusko County Highway Department Superintendent and Engineer Rob Ladson, NiBlock, of Columbia City, one of the many companies building the Wal-Mart SuperCenter on Ind. 15, traveled CR 200N to and from a gravel pit on CR 100E, in city limits, during January and February.

As part of an agreement with the county, NiBlock agreed to repair the county road. No tax dollars were to be used.

However, NiBlock disagreed with the requirements, Ladson said, until an agreement between NiBlock and the county was reached at the end of July. NiBlock agreed to do the repairs on the road, but "haven't got to it," said Ladson.

The county highway department is doing patch work on the road, Ladson said, if it concerns the immediate safety of drivers. The county isn't even supposed to be doing that, he said, under the agreement.

On Aug. 14, the county highway department sent a letter to NiBlock telling them they had 30 days to make repairs on CR 200N.

"As of yet, (I have received) no schedule date when they're going to be done," Ladson said. If NiBlock does not repair CR 200N as required, Ladson said the highway department will consult the county's attorney.

If legal action is taken, Ladson said it could further delay any work on CR 200N, but he must follow procedures.

"It is not the city's fault at all," Ladson said. "I want to make that clear."

Severals calls to NiBlock were not returned by press time.
