An update to Kosciusko County’s agreement with Bowen Health for services was unanimously approved by the county commissioners Tuesday.
Presented by county attorney Ed Ormsby, he said, “Bowen Health is the county’s community mental health center under Indiana statute. The amount for the agreement for services for 2026 is $841,421. That is figure pursuant to statute by the Indiana Department of Local Government and Finance.”
He said the agreement has been updated so that it’s in compliance with Indiana Code 12-21-2-1.1, “which makes it a requirement that the community mental health center, in order to receive these funds, does not have any individual employee that is receiving compensation of $400,000 or more per year.”
Ormsby said that portion of the statute has been incorporated into the agreement so Bowen Health can confirm it is in compliance and is eligible to receive the funds.
Indiana Code 12.29.2-1.1, which is included in the affidavit for Bowen Health President and CEO Dr. Robert Ryan, states, “Beginning after June 30, 2025, if a community mental health center provides compensation to any individual employee (not including clinical staff), including salary and benefits, in an amount that is four hundred thousand dollars ($400,000) or more per year then the community mental health center is not eligible to receive funding from: (1) local property taxes; or (2) state programs or grants; excluding the Medicaid program.”
The state law applies to any community mental health center in Indiana, not just Bowen Health.
The agreement update was approved by the commissioners 3-0.
In a statement provided Tuesday afternoon by Bowen Health President and CEO Dr. Rob Ryan, he said, “Bowen Health has been in compliance since the new code took effect in July 2025, and will continue to be in compliance moving forward.”
