BZA Approves 18 Of 22 Petitions

Of the 22 cases before the Kosciusko County Board of Zoning Appeals Tuesday, two were denied, one was dropped and a fourth was continued.

Perry Pence's petition for a variance to allow existing residence additions to remain as placed 15-30 feet from the water's edge was one of the approved, but it came with a price of $300. Pence sought the variance after the residence additions already were built, and the $300 was the amount the BZA approved to settle on for the violation. If Pence doesn't agree to the settlement or doesn't pay it, the BZA can take him to court.

Pence's property is on the north side of Promontory Point Drive and zero feet south of Papakeechie Lake in Turkey Creek Township.

Weaver Furniture's petition for an exception to allow the expansion of a non-conforming sign to remain as increased in an agricultural district was one of the two petitions denied. According to the BZA, the sign as increased blocks the view of the intersection.

The property is on the west side of Ind. 19 and zero feet north of CR 1350N in Scott Township.

Also denied was Steven Divelbiss' petition for a variance to permit an attached garage 13 feet by 22 feet, 2.1 feet from the road right of way, 5 feet from the east side line and 14 feet from the water's edge. The property is on the southwest side of EMS W16B Lane and zero feet east of Webster Lake in Tippecanoe Township.

Brown petitioned for a variance to permit a residence to remain as placed 8.5 feet from the southwest property line and a deck 23.9 feet from the right of way. His petition also sought to allow a small accessory building to be 20 feet from the water's edge.

The BZA approved the residence to remain but denied the shed.

Brown's property is on the northwest side of EMS W17 Lane and 100 feet northeast of EMS W17C Lane in Tippecanoe Township.

W. James McCleary's petition for a variance to permit allowing an existing duplex to remain as placed, sharing a common wall on two different lots, and for it to remain zero feet from the south line on lot 9 and zero feet from the north line on lot 10, was dropped. The property is on the north side of Wooster Road and 500 feet south of U.S. 30 in Wayne Township.

Cindy Scott's petition for an exception was the only petition Tuesday to be tabled. It will be heard Oct. 14.

Scott's exception is for the purpose of the change and alteration of a nonconforming tract by removing two existing residence and rebuilding eight units of a two-story apartment complex and to construct a recreation hall, pool and nine seasonable rental cabins with existing marina use. The petition also seeks to convert a residence to an office in a residential district.

The property is on the north side of EMS B1 Lane and zero feet west of EMS B1 Lane in Tippecanoe Township.

The BZA meets publicly at 8:30 a.m. in the Justice Building meeting room on the second Tuesday of every month.
