Tabled at the Nov. 5 meeting, a petition by Rick Weed for a use variance for a waste removal facility in an R-1 district will be reconsidered Monday by the Warsaw Board Of Zoning Appeals.
Weed has operated the facility at 504 E. Baker St., on 38.38 acres, since 1998. Initially the Indiana Department of Environmental Management permitted two 1,000-gallon wastewater tanks for operation: one above ground and one below ground.
Recently Weed installed two in-ground 3,000-gallon tanks without permits.
A use variance has never been sought by Weed. The business is being operated without proper permits.
A petition by Arrow Um, 1987 N. Detroit St., to operate a wireless communication facility in a C-2 district also will be considered.
Steve and Connie Rufenbarger, 1131 Country Club Drive, will return to the BZA with a 14-foot rear yard setback for a new single family residence.
The Rufenbargers appeared before the board in October asking for a 12-foot, 9-inch setback for their new home, and were denied.
At that time the board expressed its concerns regarding vehicles parked in the Rufenbarger driveway and its proximity to the road.
Several Country Club Drive residents appeared at the meeting to remonstrate against the setback.
The required rear yard setback is 25 feet.
The board also will hear a request from Stuart Baney, 770 W. Market St., for a variance from development standards for two accessory structures on one zoned lot.
