Warsaw Board of Zoning Appeals Monday denied a variance request to allow a cheerleading instructional facility in an area zoned industrial.
Petitioner Tim Sammons requested the variance to permit the facility at 1155 Executive Drive.Steve Snyder, attorney representing McDonald's Delivery, 1100 Executive Drive, said his client had safety concerns with allowing a commercial establishment in an industrial district.
"You are allowing someone to disregard the zoning ordinance and conduct business if you approve the variance on a piece of land that prohibits that activity," Snyder said.
He said his client has safety concerns with additional traffic in the area that would be generated by the parents dropping off youth attending cheerleading instruction classes in the evenings.
Board President Bruce Woodward said he also had safety concerns with the mixture of delivery traffic and youth who would be coming to the cheerleading instructional facility.
City Council representative Kyle Babcock said the city has put a lot of effort into developing its zoning standards.
"I think we need to adhere to the rules we have," Babcock said.
The board will meet again Aug. 24 at 7 p.m. at city hall.
Board members are Mary Ellen Rudisel-Jordan, Rick Keeven, Diana Rhoades, Woodward, Jeremy Skinner and Tom Allen.
