Zoners Approve Variance Requests

Joe Hamilton, of 1127 Country Club Lane, presented a request to the Warsaw Board of Zoning Appeals Monday for a variance from developmental standards to allow a 0-foot setback on his property.

Hamilton said he wants to replace siding on his house and convert his current carport into an enclosed garage.

After hearing Hamilton's request, member Dan Hampton presented letters the board received concerning the matter.

One letter came from George Clemens, recommending approval of the request. Clemens said Hamilton's proposed housing improvements would cause no problems and could help beautify the neighborhood.

Another letter from Doris Kesler, of 1125 Country Club Lane, disapproved of Hamilton's request, stating she did not wish to be encroached upon by the Hamilton residence during and after the requested construction.

After Hampton read the letter, member Rick Keevan informed the board he had been contacted by Paul Refior, Kesler's attorney, requesting the letter be withdrawn.

The board then voted unanimously to approve Hamilton's request, allowing the variance.

Dawnna Plummer requested a variance to allow for a massage therapy home occupation at her property, 2705 Marion Avenue.

City planner Jeremy Skinner informed Plummer of time restrictions and bathroom requirements enforced by a recent town ordinance regarding massage establishments.

"I won't have a problem with time restrictions," Plummer said. "And just so everyone knows, I'm not doing anything along the lines of what the ordinance involves."

Plummer's neighbors, Rick and Kelsey Enyart, of 2703 Marion Avenue, spoke in favor of the request. The board then approved the allowance.

Bruce Woodward presented a request before the board asking for a variance from developmental standards to allow for a backing into a public right of way from C-2 zoned parking.

The existing property, 616 S. Buffalo St., currently experiences parking problems and wished to redesign the lot.

The board unanimously approved Woodward's request.

The board also:

• Approved Gilbert and Rosella Hawkins' request for a variance to allow a 10-1/2-foot setback on his property, 1503 E. Fort Wayne St., for the installation of a deck beside the house.

Present members were Hampton, Woodward, Keevan, Alan Clingan, Tom Heuer and council representative Bill Rhoades.
