Wrongful Death Suit Filed Against Tippecanoe Valley

The family of a Tippecanoe Valley High School student killed in an incident at the track last fall has filed a wrongful death lawsuit against the school corporation.
On Sept. 2, 2008, Evelyn Bolen died after she was hit by a bicycle ridden by another student, Jordan Stamberger.
The suit, filed earlier this month, alleges that the school corporation is responsible for the death because physical education teacher Greg Sciarra allowed Stamberger to ride the bike while Bolen was walking on the track.
The lawsuit also states, "That during the course of his riding, defendant Jordan Stamberger did become distracted and as a result thereof did negligently and recklessly strike decedent Evelyn Bolen with the bicycle.
"That the collision was of such great force that it caused Evelyn Bolen to be thrown to the surface causing severe damage to her brain and spine resulting in her death.
"That the actions of the Tippecanoe Valley School Corporation, by its physical education teacher Greg Sciarra, were reckless and negligent in permitting a student to ride upon the track."
Bolen's estate seeks all damages that are available under the law from the school and a judgment that is "just and proper" from the Stamberger family.
