Wrongful Death Suit Filed

Wrongful death allegations are made in a civil lawsuit filed last week in Kosciusko Superior Court I against a Leesburg man accused of murder.

Marcus Creekmore, personal representative of the estate of Samuel Creekmore, is the plaintiff in the case against Jason P. Davidson.

Davidson, 32, of Leesburg, is being held without bond in the Kosciusko County Jail on a charge of murder and a firearms enhancement offense. Davidson is accused of shooting Creekmore five times on May 2 at Creekmore's Bluebird Drive residence in Melody Acres, west of Warsaw.

At the time of his death, Creekmore was married to Davidson's ex-wife, Alicia Davidson-Creekmore.

According to the lawsuit filed Wednesday, Davidson "owed Samuel Creekmore a duty not to cause harm or injury to his person" and that Davidson's "breach" of that duty "wrongfully caused the death of Samuel Creekmore."

The lawsuit notes that Creekmore was the father of two daughters, ages 6 and 2.

An unspecified amount of compensation is being sought through the case "in an amount sufficient to punish (Davidson) for his intentional, wrongful, and reckless disregard for the life of Samuel Creekmore."

A trial by jury is requested.

Marcus Creekmore is a resident of Hancock County. The attorneys for the estate are Eric N. Allen and Kevin G. Harvey of Allen Wellman McNew, Greenfield.
