A drainage variance available to residents who live within the Maish drain easement along Old Road 30 to Zimmer Road was approved at the Warsaw Board of Public Works and Safety meeting Friday.
The Kosciusko County Drainage Board granted the variance to apply to owners of real estate within the drainage easement area. The easement also will have the potential use as a greenway path.
City Planner Jeremy Skinner presented the variance proposal to the board.
According to the variance, The Kosciusko County Drainage Board has jurisdiction over the Maish drain and owns an easement 75 feet on either side of the drain along a 10 foot path.
"The variance should include a temporary right of use of the drain easement in addition to the finished pathway sufficient for the construction of the pathway," Skinner said.
The nearest edge of the path should be no closer than 15 feet from the top of the ditch bank as determined by the county surveyor.
Skinner also presented an in lieu of annexation item.
He informed the board that a home owner at 1830 Sharon Street wished to tap onto Warsaw sanitary sewer service, but the property was located outside Warsaw city limits.
"A sanitary sewer line runs behind the property in the utility easement," Skinner said.
Kosciusko County requested that the property be connected to the available sewer as it is within 100 feet of an available sewer.
The agreement is for a four year term and if the land is not annexed at the end of the term then the city reserves the right to discontinue all city services to the property, according to the agreement.
Skinner stated he would like to look at other properties that might need annexation in the area.
During the meeting the board also approved street closings to accommodate the Lincoln Highway Celebration to be held Aug. 12 in Warsaw.
Carmen Lock, executive director of the Warsaw Community Development Corporation, said that Center Street from Lake to Indiana Streets and Buffalo Street from Center to Markets streets will close at 6 a.m.
They will reopen after the Shriner's parade that begins at 5 p.m.
Lock said the event will include over 500 miles of yard sales along the Indiana and Ohio Lincoln Highway.
A big wheel race, watermelon feast and games for children also will be a part of the event.
