Woman Posing As Underage Girl Results In Elkhart Man’s ArrestAn Elkhart man was arrested Friday on child solicitation charges.
Devin Michael Brown, 26, is charged with child solicitation, a Level 4 felony.
Brown was booked into the Kosciusko County Jail at 11:32 a.m. Friday with a $15,250 preliminary bond.
According to the probable cause affidavit filed Dec. 21, at about 7:59 p.m. Oct. 7, a Warsaw police officer responded to a dispatch call about a child predator at a movie theater in Warsaw. Upon arrival, the officer spoke with a woman who works for Predator Catchers Inc. The woman stated she was communicating with someone identified as Brown on a social media app utilizing a wireless cellular device over a computer network. The woman said she was acting as a decoy child, age 13, on the app, trying to catch child predators. The woman said early on in the messaging, she told Brown multiple times she was a 13-year-old girl.
During the investigation, officers learned between Sept. 30 and Oct. 7, the woman exchanged messages with Brown, which started out as cordial then became sexual, according to court documents. Officers obtained a phone download and were able to see the text conversation. In the messages, Brown asks the woman how many times she had sex. He said he had a fantasy of being with a younger girl, around the age of 10 to 14.
In the text conversation, Brown arranged to meet the 13-year-old girl and her 7-year-old cousin at the movie theater. The plan was made he would buy three tickets to see a movie and Brown would bring condoms and Plan B pills for the girls to take after they had sex in the dark theater. The woman asked if the girls should wear skirts to the movie theater and Brown said it would make it easier for him, according to court documents. Brown allegedly said either of the girls could sit in his lap.
Brown showed up to the theater and purchased three tickets to see a children’s movie. While at the theater, he was confronted by the woman and videotaped on Facebook Live. Brown allegedly did not deny he came to the theater to meet the girls to have sex. Brown admitted to having condoms and Plan B in his pocket, according to court documents.
Brown voluntarily went to the Warsaw Police Department for an interview. Brown waived his Miranda Rights and told officers he got in contact with the woman who he thought was 13 on a social media app. Brown said they struck up a friendship over their disgust with the town of Elkhart. Brown said, over the course of a couple weeks, he believed he could help the child, as a role model. But then the conversation began to get sexual, and he wanted to meet up for sexual activities with the 13-year-old.
Brown said he picked up condoms and Plan B as a precaution for sex. When he arrived at the movie theater, he bought three tickets for himself, the 13-year-old and the 7-year-old. Brown said when the woman confronted him at the theater, he knew he was not meeting the child, according to court documents. Brown said his fantasies stemmed from watching Japanese anime films.
Brown consented to the download of his phone. An officer downloaded the contents of the phone and located explicit and graphic text messages from Brown to the woman, in which Brown said he knows the woman is 13, he has fantasized about being with a child, how the girls were going to sit on his lap in the theater and graphic language about Brown wanting to have sex with the girls, according to court documents.
