Winona Lawsuit

The town council of Winona Lake would like to reply to a recent article by Mr. Jerry Nelson in order to state the facts regarding an ongoing lawsuit.

The United States of America Justice system has been called upon four times to determine the truth in this ongoing lawsuit brought upon the town of Winona Lake by Mr. Nelson and others. Town of Winona Lake has sought the truth, seeking justice for all.

What was determined by United States judges following four separate hearings, at an $85,000 cost to taxpayers, is that the land the Nelsons and other island residents request for ownership sits beyond their individual, designated purchased land. Two judges representing the United States of America determined, in four separate requested court hearings by Mr. Nelson and the others, that the land does not belong to the plaintiffs.

It appears to the town of Winona Lake that the four court hearing judgments were not the answer that those suing want to hear because Mr. Nelson and the island residents are moving the hearing to the United States Supreme Court. Every Winona Lake community member continues to pay for the hearing and ongoing litigation fees.

The Winona Lake Town Council members regret the cost incurred to our local taxpayers. The council believes the $85,000 was a waste of money and more so, creates division versus development.
