NOTICE OF OFFER BY THE TOWN OF WINONA, LAKE, INDIANA TO SELL CERTAIN TRACTS OF REAL ESTATE NOTICE IS HEREBY GIVEN that the Town Council of the Town of Winona Lake, Indiana is offering the following Tracts of real estate numbered 1 through 10 for sale. The tracts and the larger tract of which the tracts are a part do not have an assessed value and did not have an assessed value at the time the real estate was acquired by the Town. The offering price is the amount Four Hundred Seventy One and 44/100 Dollars ($471.44) for Tract 1, Three Hundred Fifty Three and 58/100 Dollars ($353.58) for Tract 2 and One Hundred Seventeen and 86/100 Dollars ($117.86) for each of the remaining tracts plus all costs associated with the sale, including but not limited to: (1) appraisal fees (at this time there are none); (2) title insurance; (3) recording fees; (4) advertising costs. (5) deed preparation and closing costs, Additional Terms and Conditions are as follows: (1). The property may not be sold to a person who is ineligible under IC 36-1-11-16; and (2) An offer to purchase the property submitted by a trust (as defined in IC 30-4-1-1(a)) must identify each: (A) beneficiary of the trust; and (B) settlor empowered to revoke or modify the trust. (3) Offers to purchase one or more tracts are to be submitted in writing to the Town Council by submitting the offer to the Town Coordinator of the Town directly or by delivery to the Office of the Clerk Treasurer of the Town of Winona Lake, Indiana at 1310 Park Avenue, P.O. Box 338, Winona Lake, Indiana 46590 for delivery to the Town Coordinator. (4) Offers are open for inspection. (5) Offers can be submitted and resubmitted for a tract until the tract is sold. (6) If within ten (10) days after the date of the second publication of this notice, only one abutting landowner makes an eligible offer to purchase the tract then the disposing agent shall offer to negotiate for the sale of that tract to the abutting landowner, otherwise the sale will be conducted as provided for by IC 36-1-11-5. (7) The offering of the tracts for sale may continue for as long as permitted by law, unless earlier terminated by the Town Councilor by sale of the tracts. Description of Tracts Being Offered for Sale The following Tracts of Real Estate in the Northwest Quarter of Section 22, Township 32 North, Range 6 East, Wayne Township, Kosciusko County, Indiana, which are a part of a larger Tract identified as Key Number/Parcel/D 006-110-134, which tracts are approximately 13.47 feet in width and are bounded on the East by the Eastern Section Line of said Northwest Quarter, and identified as follows, to-wit: Tract 1: A tract of land bounded on the North by the extension of the North Line of Lot Number 530 in the Original Plat of Winona Park extended east to the East Section Line of said Northwest Quarter Section, bounded on the East by the East Line of said Quarter Section, bounded on the south by the South Line of Lot Number 533 in said Original Plat of Winona Park extended East so the East Section Line of said Northwest Quarter Section, and bounded on the West by the eastern lot lines of Lots 530 through 533 in said Original Plat of Winona Park. Tract 2: A tract of land bounded on the North by the extension of the North Line of Lot Number 534 in the Original Plat of Winona Park extended east to the East Section Line of said Northwest Quarter Section, bounded on the East by the East Line of said Quarter Section, bounded on the south by the South Line of Lot Number 536 in said Original Plat of Winona Park extended East so the East Section Line of said Northwest Quarter Section, and bounded on the West by the eastern lot lines of Lots 534 through 536 in said Original Plat of Winona Park. A tract of land bounded on the North by the extension of the North Line of Lot Number 537 in the Original Plat of Winona Park extended east to the East Section Line of said Northwest Quarter Section, bounded on the East by the East Line of said Quarter Section, bounded on the south by the South Line of Lot Number 537 in said Original Plat of Winona Park extended East so the East Section Line of said Northwest Quarter Section, and bounded on the West by the eastern lot line of Lot 537 in said Original Plat of Winona Park. A tract of land bounded on the North by the extension of the North Line of Lot Number 538 in the Original Plat of Winona Park extended east to the East Section Line of said Northwest Quarter Section, bounded on the East by the East Line of said Quarter Section, bounded on the south by the South Line of Lot Number 538 in said Original Plat of Winona Park extended East so the East Section Line of said Northwest Quarter Section, and bounded on the West by the eastern lot line of Lot 538 in said Original Plat of Winona Park. A tract of land bounded on the North by the extension of the North Line of Lot Number 539 in the Original Plat of Winona Park extended east to the East Section Line of said Northwest Quarter Section, bounded on the East by the East Line of said Quarter Section, bounded on the south by the South Line of Lot Number 539 in said Original Plat of Winona Park extended East so the East Section Line of said Northwest Quarter Section, and bounded on the West by the eastern lot line of Lot 539 in said Original Plat of Winona Park. A tract of land bounded on the North by the extension of the North Line of Lot Number 540 in the Original Plat of Winona Park extended east to the East Section Line of said Northwest Quarter Section, bounded on the East by the East Line of said Quarter Section, bounded on the south by the South Line of Lot Number 540 in said Original Plat of Winona Park extended East so the East Section Line of said Northwest Quarter Section, and bounded on the West by the eastern lot line of Lot 540 in said Original Plat of Winona Park. A tract of land bounded on the North by the extension of the North Line of Lot Number 541 in the Original Plat of Winona Park extended east to the East Section Line of said Northwest Quarter Section, bounded on the East by the East Line of said Quarter Section, bounded 011 the south by the South Line of Lot Number 541 in said Original Plat of Winona Park extended East so the East Section Line of said Northwest Quarter Section, and bounded on the West by the eastern lot line of Lot 541 in said Original Plat of Winona Park. A tract of land bounded on the North by the extension of the North Line of Lot Number 542 in the Original Plat of Winona Park extended east to the East Section Line of said Northwest Quarter Section, bounded on the East by the East Line of said Quarter Section, bounded on the south by the South Line of Lot Number 542 in said Original Plat of Winona Park extended East so the East Section Line of said Northwest Quarter Section, and bounded on the West by the eastern lot line of Lot 542 in said Original Plat of Winona Park. A tract of land bounded on the North by the extension of the North Line of Lot Number 543 in the Original Plat of Winona Park extended east to the East Section Line of said Northwest Quarter Section, bounded on the East by the East Line of said Quarter Section, bounded on the south by the South Line of Lot Number 543 in said Original Plat of Winona Park extended East so the East Section Line of said Northwest Quarter Section, and bounded on the West by the eastern lot line of Lot 543 in said Original Plat of Winona Park. Tract 10. A tract of land bounded on the North by the extension of the North Line of Lot Number 544 in the Original Plat of Winona Park extended east to the East Section Line of said Northwest Quarter Section, bounded on the East by the East Line of said Quarter Section, bounded on the south by the South Line of Lot Number 544 in said Original Plat of Winona Park extended East so the East Section Line of said Northwest Quarter Section, and bounded on the West by the eastern lot line of Lot 544 in said Original Plat of Winona Park. The foregoing tracts are subject to all easements and encumbrances of record or ascertainable by survey.
