RUSSELLVILLE, Ky. - A 12-person Kentucky jury found a Warsaw woman not guilty of several felony charges including murder Friday night.
After more than three hours of deliberation Friday, the jury decided that Mickey Mosher, 55, of Warsaw, was not guilty on two counts of murder and manslaughter, one count of assault, four counts of wanton endangerment and driving while intoxicated. The jury decided Mosher was guilty of one count of possession of marijuana.
Mosher was involved in an accident that killed two men and injured another in a June 3 crash on U.S. 79 in Kentucky. Mosher was arrested Jan. 11 after allegedly testing positive for marijuana. Mosher crossed the center line of the highway and hit three motorcycles.
Prosecutors argued that Mosher smoked marijuana within three hours of the accident, which killed Cornelius Martin, 57, a motorcycle and automobile dealer, and Brooks Mitchell, 51, president of Hancock Bank and Trust. Bill Leachman, 61, lost a leg as a result of injuries suffered in the crash.
During the trial, Mosher's attorney argued that there was not proof Mosher was under the influence of marijuana at the time of the crash. No information was presented in the case as to how much marijuana was in her system when the crash occurred.
Mosher, who admitted she has smoked marijuana for 32 years, said she smoked marijuana the night before the crash.
Mosher still faces another trial in Logan County for charges of possession of marijuana, possession of paraphernalia and promoting contraband. Mosher reportedly failed a drug test while she was out on bond in the murder case. She reportedly had marijuana in her possession when she went to the Logan County Jail for a drug test.
