NOTICE TO PUBLIC AND BIDDERS Notice is hereby given that the City of Warsaw, Indiana, acting by and through its Board of Public Works & Safety (the “Board”), will receive sealed bids until the hour of ten thirty (10:30) a.m., local time, Friday, January 16, 2015, at the Office of the City Clerk-Treasurer, City Hall, 102 S. Buffalo Street, Warsaw, Indiana, 46580 for the following equipment: (1) Three Wheel Mechanical Street Sweeper Sealed bids must be submitted on the form provided in the bid package, accompanied by a Non-Collusion Affidavit by ten thirty (10:30) a.m. on Friday, January 16, 2015. Bids received after such hour will be returned unopened. Bids will be opened publically and read aloud immediately thereafter, at the regularly scheduled Board of Public Works and Safety meeting in the Council Chambers located in City Hall following the proposal deadline. Bids shall be addressed to the attention of the Board of Public Works & Safety, 102 S. Buffalo Street, Warsaw, Indiana 46580, and shall be clearly marked with the bidder’s name and address, the date and time of the bid opening, and the words, "Sealed Bids – Stormwater Utility, Three Wheel Mechanical Street Sweeper". Specifications are on file and available at the Office of the City Clerk-Treasurer City Hall, 102 S. Buffalo, Warsaw, Indiana and may be reviewed between the hours of eight (8:00) a.m. and four (4:00) p.m. Monday through Friday. Approved performance bond guaranteeing the faithful and proper performance of the work, to be executed by an acceptable surety company, will be required of the bidder at the time of the contract execution. The bonds shall be in the amount of 100% of the contract price and must be in full force and effect through the term of the contract plus a period of twelve (12) months from the date of completion. Liquidated damages in the amount of $500 per day of delayed or unsatisfactory completion of the contract, beyond the agreed upon completion date, shall be paid by the bidder to the City pursuant to the terms and conditions of the written contract ultimately entered into by the successful bidder. The Board reserves the right to reject any and all bids, to waive any informalities, irregularities or omissions in any bid, or to accept a full or partial bid, which, in its judgment, will be in the best interest of the City of Warsaw. Any proposal may be withdrawn prior to the above scheduled time for the opening of the proposals or authorized postponement thereof. Any proposal received after the time and date specified shall be returned unopened. No proposals may be withdrawn after the scheduled closing time for receipt of bids for at least sixty (60) days. Award will be made to the lowest responsible and responsive bidder. The lowest responsive and responsible bidder will be determined by the City. The City is exempt from all federal, state, and local taxes, and will not be responsible for any taxes levied on the bidders as a result of the award.
