Warsaw Man Held In Rape CaseA Warsaw man was arrested for rape after allegedly forcing himself on a teenager while she was sleeping.

Brandon Gregory Nissley, 21, of 111 Canterbury Lane, Warsaw, was arrested and booked into the Kosciusko County Jail at 5:58 a.m. Monday for rape, a level 3 felony, and sexual misconduct with a minor, a level 4 felony. Preliminary bond was set at $20,250.

On Monday, Warsaw Police officer Kelly Brown conducted a traffic stop involving a maroon Chevy Tahoe for failure to dim its lights. Brown talked with the driver, referred to as “BB” in court documents. Also in the Tahoe was Nissley and “AA.”

BB told Brown she had witnessed Nissley rape AA, court documents state.

When WPD Sgt. Gordon Allen asked AA if there was anything she would like to report, she stated she had been raped by Nissley sometime shortly after July 4.





WPD officer RJ Nethaway and Allen interviewed AA. She said sometime after July 4, she was spending the night with BB at BB’s grandmother’s house. Between 2 and 3 a.m., while AA and BB were sleeping on opposite ends of a couch, AA was awakened by Nissley touching her genitalia. She told him to stop and he did.

She was awakened a second time when Nissley pulled her pants down, held her wrists and forced her to have sex. BB woke up and started telling Nissley to stop, at which time AA was able to get away and run out of the house.

 AA is between the ages of 14 and 16, according to court documents.

BB confirmed the circumstances provided by the victim.

After Nethaway advised Nissley of his rights, Nissley said he wanted to speak about the incident.

He said he struggles with pornography and social media. He told Nethaway that even though he knew she was underage, he started kissing her and touching her breasts. He then admitted to pulling the girl’s pants down and having sex with her.

Nissley told AA if she went to the police he would tell them she had been drinking that night. He also told BB by text message that if she told police he would beat her up and say they stole liquor from a grocery store.

Nissley completed a handwritten apology letter to AA stating he was sorry for what he did.
