Warsaw Man Facing Weapon ChargesA Warsaw man was arrested after an incident where he allegedly pointed a gun at a woman.
Jose Angel Olivarez Jr., 43, of 413 Chamberlin Drive,?Warsaw, is charged with intimidation with a deadly weapon, a Level 5 felony; and pointing a firearm, a Level 6 felony.
Olivarez was booked in the Kosciusko County Jail at 2:40 a.m. Sunday, with an $11,000 surety and cash bond.
According to the probable cause affidavit, on Sunday, Warsaw police responded to a report of intimidation with a deadly weapon at a residence. Upon arrival, police spoke with a man who said his mother had texted him Olivarez had grabbed a handgun and pointed it at her while threatening to break the woman’s phone.
The man told Olivarez to come to his residence, where Olivarez was intoxicated and showed the man the handgun.
The man said Olivarez ejected the loaded magazine of the handgun to show the man there wasn’t a round in the chamber. The man said Olivarez admitted to pointing the gun at the woman.
Police spoke with the woman who stated she had returned from work on Sunday and she and Olivarez began arguing. The woman stated Olivarez was intoxicated and, during the argument, Olivarez grabbed a handgun from the kitchen area and walked up to her and demanded to look at the phone, according to court documents.
The woman said when she refused, Olivarez raised the gun and pointed it at her and the phone. Olivarez said he would break the phone if she didn’t give it to him.
The woman said she feared Olivarez was going to shoot her, but Olivarez then lowered the firearm and walked away, according to court records.
Police read Olivarez his Miranda rights and Olivarez agreed to speak with police. He admitted to being intoxicated and arguing with the woman. He denied pointing the gun at the woman, according to the court documents.
Several handguns were found in Olivarez’s bedroom with a Kimber 9mm identified as the gun pointed at the woman. The Kimber 9mm was located with a loaded magazine of live ammunition, according to court documents.
