Warsaw Man Arrested On Child Molesting, Battery ChargesA physical altercation led to the arrest of a Warsaw man for child molestation.
Justin Nathan Frazier, 24, of 3043 Inverness Point, Warsaw, is charged with child molesting, a Level 4 felony; attempted strangulation, a Level 6 felony; and battery, a Class B misdemeanor.
He was booked into the Kosciusko County Jail at 7:06 p.m. Aug. 10. His bond was tentatively set at $5,250.
According to the probable cause affidavit filed Friday, Warsaw police responded to a fight in progress. Upon arrival, police could hear the sounds of crying, dogs barking, yelling and items breaking inside the residence.
Two young female juveniles came running out the residence. They were crying and screaming and went toward police.
Police knocked on the door of the residence, identifying themselves. The door latch popped and police heard someone yell, “Get off me,” according to the affidavit.
Police heard additional children inside the residence and loud thuds police believed to be the result of fighting.
Police opened the door and saw a man, later identified as Frazier, on top of another man. Police gave the two men verbal commands and Frazier then left the residence, followed by the other man and two more juveniles. Additional officers arrived on scene to assist.
Frazier said he was in his room when the other man called him a “chomo.” Frazier said this upset him because he is not a child molester, according to the affidavit. Frazier said the other man slammed a door on him and that his how Frazier got a large red mark on his back. Officers later learned the red mark was when a juvenile struck Frazier in the back with a stick to try to get Frazier off the other man.
Officers spoke with the juvenile, who said they saw Frazier and a victim making out in a bedroom of the residence.
Police spoke with the victim at the scene. During the conversation, the victim initially denied anything happened between the victim and Frazier, but when asked why people said something happened, the victim said she and Frazier kissed one time a week or two prior, according to the affidavit.
When police talked with the other man, he said he and Frazier were arguing and the other man told the kids under 18 to leave Frazier’s room. Once the kids left the room, Frazier pushed and choked the other man around the neck, according to court documents. The other man said Frazier was bad at grappling, so it didn’t stress him out.
On Aug. 10, Safe Harbor Advocacy Center completed a forensic interview with the victim, who disclosed spending time alone with Frazier in a bedroom in the residence. The victim said she was laying on the bed and covered up because it was cold. The victim said Frazier hugged her and slapped the victim on the butt. The victim went to the bathroom and, when the victim returned to the room, the victim laid down on the bed and Frazier laid down next to her. According to court documents, Frazier touched her on the thigh area and said he loved her and kissed her on the mouth. According to the victim, the kissing incident happened in July.
On Aug. 10, police spoke with Frazier about the argument with the other man. Frazier, according to court documents, admitted to choking the other man and claimed they were choking each other. Frazier admitted the victim sleeps in his bedroom with him. He admitted to kissing the victim on one occasion. He reported it occurred within a month prior. Frazier also allegedly admitted to having a flirting relationship with the victim.
According to the court documents, Frazier is on pretrial release and on a pretrial diversion agreement entered into the Kosciusko County Court on March 29 for possession of methamphetamine. He has a prior conviction of battery, a Class A misdemeanor, in Kosciusko Superior Court II, according to court documents.
