NOTICE TO THE PUBLIC OF ADOPTION OF RESOLUTION DESIGNATING AN ECONOMIC REVITALIZATION AREA AND PUBLIC HEARING ON SUCH DESIGNATION AND ON A REQUEST FOR ADOPTION OF WAIVER Notice is hereby given that on August 12, 2010, the Kosciusko County Council adopted Economic Revitalization Area Declaratory Resolution No. 10-08-12-003 ERA, which Resolution provides in substance as follows: Whereas the real estate located at 2666 S. Country Club Road, Warsaw, IN 46580, as more fully described in the Resolution ("Real Estate") has become undesirable for, or impossible of, normal development and occupancy, and the improvement of the Real Estate would benefit and would promote the welfare of all citizens and taxpayers in Kosciusko County, the Kosciusko County Council found, declared, and designated the Real Estate to be an economic revitalization area as defined in Ind. Code § 6-1.1-12.1-1 ("ERA"). The Kosciusko County Council also declared that deductions for five (5) years for new manufacturing equipment and new logistical distribution equipment installed in the ERA would be granted for qualified projects. A description of the affected area is available and can be inspected in the Kosciusko County Auditor's Office. The Kosciusko County Council also found that it should approve the Statement of Benefits filed by Midwest Rake Company, ("Midwest") for qualified projects located on the Real Estate for such 5 year abatement deductions for new manufacturing equipment and new logistical distribution equipment. Finally, the Kosciusko County Council resolved to hold a public hearing to consider Midwest's request for the adoption of a waiver under Ind, Code § 6-1.1-12.1-11.3 regarding the requirement that an economic revitalization area must be designated before the initiation of the project for which a person desires to claim a deduction under Ind. Code § 6-1.1-12,1. A public hearing On these matters will be held by the Kosciusko County Council on September 9, 2010, at 7:00 o'clock P.M, in the Commissioners Courtroom, Courthouse, 100 West Center Street, Warsaw, Indiana 46580. At this hearing, the Kosciusko County Council (1) receive and hear all remonstrances and objections from interested persons, (2) shall take final action determining whether the qualifications for an economic revitalization area have been met and confirming, modifying and confirming, Or rescinding the Resolution, after considering the evidence, and (3) shall take final action on the Statements of Benefits and the request for adoption of a waive under Ind. § 6-1.1-12.1-11.3, Marsha McSherry Auditor of Kosciusko County, Indiana August 17, 2010 a20
