NOTICE OF ENFORCEMENT AUTHORITY ORDER TO JOHN RASMUSSEN AND ALSO TO ANY AND ALL OWNERS OR HOLDERS OF ANY INTEREST IN REAL PROPERTY COMMONLY KNOWN AS 7262 WEST RACOON LANE, CLAYPOOL, INDIANA 46510

COUNTY OF KOSCIUSKO

    Pursuant to Indiana Code 36-7-9-1 et seq., as adopted by Kosciusko County Ordinance 11-11-22-001, you were ordered on September 27, 2017 to demolish and remove the unsafe structure located on real property situate in Kosciusko County, Indiana, which real property is commonly known as 7262 West Racoon Lane, Claypool, Indiana 46510, and legally described as follows:  

    Beginning at a point (468 feet) Four Hundred and Sixty-eight feet North of the Southeast corner of the Northwest Quarter of the South East Quarter of Section Thirty-three (33), Township Thirty-one (31) North, Range Five (5) East; thence West (20 feet) Twenty feet as a place of beginning of a tract of ground owned and being sold by the vender; thence West (42 feet) Forty-two feet; thence North (52 feet) Fifty-two feet; thence East (52 feet) Fifty-two to a public highway; thence slightly Southwesterly along said highway about (55 feet) Fifty-five feet to the place of beginning.

    That the said order was affirmed by the Hearing Authority on October 12, 2017, but that the order was not complied with, and that, accordingly, a contract is to be let at public bid to a contractor with all necessary licensing and legal qualifications and who is bonded to accomplish work to comply with the order.  That the work to be accomplished is the demolition and removal of the unsafe structure located at 7262 West Racoon Lane, Claypool, Indiana 46510, including pumping and filling of any septic tank and/or drywell, capping of any wellhead, and grading and seeding, but excluding removal of concrete slab foundations.  All garbage and debris must be removed from the premises.  

    Both the bid price of the contractor who accomplishes the work and an amount representing a reasonable estimate of the cost incurred by the enforcement authority in processing the matter of the unsafe premises may, if not paid, be recorded after a hearing as a lien against all persons having a fee interest, life estate interest, or equitable interest of a contract purchaser in the   unsafe premises.

    Sealed bids will be received by the Kosciusko County Health Department, 100 West Center Street, Warsaw, Indiana 46580, until 3:00 PM prevailing local time on the 26th day of April, 2018.  All bids will then be publicly opened and read aloud in the Kosciusko Courthouse at 100 West Center Street, Warsaw, Indiana 46580, on 26th day of April, 2018, at 3:00 PM, in the Old Courtroom located on the Second Floor.

    A copy of the statement of public bid may be obtained from the Enforcement Authority at the Kosciusko County Health Department, 100 West Center Street, Warsaw, Indiana 46580.
