Three counts of aggravated battery and two counts of misdemeanor battery were filed against a Warsaw man accused of child abuse. The child's mother also faces charges.
Milton Forest Bain Jr., 29, of 206 Ra-Mar Drive, Warsaw, is being held in the Kosciusko County Jail on $20,000 bond. Charged with one count of aggravated battery was Dusty Elaine Noselotl, 21, of 111 Fourth St., Pierceton. She is being held in the county jail on $2,000 bond.
According to court documents, Bain and Noselotl allegedly spanked Noselotl's 16-month-old daughter on July 17, causing bruises on her back. An investigation involving the Warsaw Police Department and Kosciusko County Division of Family and Children revealed that the child previously suffered injuries at the hands of Bain, including a broken leg and a fractured skull.
The child was treated at Kosciusko Community Hospital on June 2 for a skull fracture to the back of her head after suffering a bruise to the front of her head on June 1. On June 30 the child was treated at KCH for a leg fracture.
Bain reportedly admitted to inflicting one of the head injuries on the child by jerking her out of her high chair by the shirt causing her to hit her head on a table or chair. The other head injury was caused by slamming her head into a wall and by pushing her out of her crib. He also allegedly grabbed the child by her foot and twisted and pulled it, causing her leg to break.
Noselotl reportedly told police she lied about how her daughter's skull fracture occurred in an attempt to protect Bain.
Also noted in the probable cause affidavit - the paperwork filed with the Kosciusko County prosecutor to support the requested charges against Bain - were other alleged incidents of abuse against Noselotl's child, as well as incidents involving Bain's sons, now ages 3 and 5, between 1994 and this July.
Among the allegations which Bain reportedly volunteered to police are that he pulled the boys' hair, spanked them on the buttocks hard enough to knock them down and punched them in the stomach with his fist to knock the wind out of theme to get them to stop crying.
Also, sometime between April and July, Bain allegedly covered the mouth of Noselotl's daughter with his hand until she turned blue in the face in an attempt to stop her from crying.
The officer investigating the case requested that two Class B felony aggravated battery charges be filed against Bain, as well as 16 counts of battery as Class D felonies, for each of the occurrences of battery Bain is accused of or admitted to committing. Bain is officially charged with five offenses.
