EXHIBIT A NOTICE OF HEARING TO: WINONA LAKE SEWAGE USERS, PROPERTY OWNERS SERVED BY THE SEWAGE WORKS, AND OTHER INTERESTED PERSONS. NOTICE IS HEREBY GIVEN that on the 23rd day of December, 2008, Ordinance Numbered 2008-11-1, entitled Sewage Rates Structure Ordinance, An Ordinance Amending Ordinance Number 2005-10-3 Fixing the Schedule of Rates and Charges for the Sewage System, and Making Other Provisions for the Sewage Works, which Ordinance establishes fees under I.C. 36-9-23-25, will be introduced before the Town Council of the Town of Winona Lake, Indiana. YOU ARE FURTHER HEREBY NOTIFIED, that on the 23rd day of December, 2008, at 7:15 a.m., at the Winona Lake Town Hall, 1310 Park Avenue, Winona Lake, Indiana, the Town Council of the Town of Winona Lake, will hold a public hearing upon said Ordinance. Users of the Sewage Works, owners of property served or to be served by the Sewage Works, other interested persons, and any member of the general public may be heard concerning the proposed fees. The proposed schedule of fees is as follows: RATE STRUCTURE UNMETERED MONTHLY RATES FLAT MONTHLY RATES UNLESS OTHERWISE NOTED 1. Single Family Residential Dwelling Units 44.00 for each unit 2. 10D Single Family Residential Units: 44.00 for each unit (5 persons constitute one unit) 3. Mobile Homes 44.00 for each unit 4. Rooming House Room 9.50 for each room 5. Bed and Breakfast, Dormitory 44.00 plus 9.50 for each Room 6. Offices, store, shops, etc. 44.00 for first two employees plus 9.50 per person over two 7. Service Stations 93.00 8. Self-Service Laundries 32.00 per machine 9. Restaurant 92.00 plus 3.00 per seat over twenty 10. Schools 3.00/student Hotels, Motels, Institutions, Publishers, and General Manufacturers based upon measured water usage as follows: First 2,000 gallons per month 18.80/thou. gal. Next 8,000 gallons per month 19.40/thou. gal. Next 30,000 gallons per month 10.75/thou. gal. Next 60,000 gallons per month 7.70/thou. gal. Over 100,000 gallons per month 6.00/thou. gal. MINIMUM CHARGES Water Meter Size Minimum Charges 3/4" to 5/8" 62.00 1" 144.00 1 1/4" 230.00 1 1/2" 384.00 2" 468.00 3" 694.00 4" 1,150.00 Other As determined by negotiation with the Town Council Dishonored Checks In addition to those fees, the Ordinance provides for a surcharge of Twenty Dollars ($20.00) or Five Percent (5%) of the check for any dishonored check, a tap fee of Two Hundred Dollars ($200.00), imposes duties for reporting changes in classifications, with a Two Hundred Fifty Dollar ($250.00) penalty for failure to report, and provides for interest upon delinquent user fees in the amount of one and one-half percent (1.5%) per month. The hearing may be adjourned from time to time, but after the hearing, the Town Council shall adopt or modify the Ordinance as is provided by I.C. 36-9-23-26.
