ORDINANCE NO. 2014 10-01 AN ORDINANCE ANNEXING CERTAIN TERRITORY TO THE TOWN OF SILVER LAKE, INDIANA WHEREAS, the Town Council of the Town of Silver Lake, Indiana, has determined that annexation of certain real estate to the Town of Silver Lake is in the best interest of Silver Lake and the residents and property owners in the area to be annexed, and that said real estate should be annexed to the Town of Silver Lake, Indiana; and, WHEREAS, said real estate is owned by Lake Township of Kosciusko County, Indiana and The Town of Silver Lake Indiana and they have petitioned the Town Council for the annexation of said real estate pursuant to Indiana Code 36-4-3-5.1; and, WHEREAS, said real estate is contiguous to the existing boundaries of the Town of Silver Lake, Indiana as defined by Indiana Code 36-4-3-1.5; and, WHEREAS, the real estate to be annexed is described on "Exhibit 1" attached to this Ordinance and made a part hereof of. EXHIBIT 1 Tract 1: The West half of Outlot Number 1 in Eli Bateman's Addition to the Town of Silver Lake. Tract II: Commencing at the Northwest corner of Outlot Number 1 in Eli Bateman's Addition to the Town of Silver Lake; thence running West 6 rods; thence South 12 rods; thence East 6 rods; thence North to the place of beginning, being a grant in the North half of the West half of the Northwest Quarter of Section 8, Township 30 North, Range 5 East. Tract III: Beginning at the Southeast corner of the West half of the Outlot Number 1 in Eli Bateman's Addition of Outlots Numbered 1 and 2 to the Town of Silver Lake as laid out, platted and recorded in the Recorder's Office of said County; running thence North 11 rods and 10 1/2 feet to the center of the alley; thence East along the center of said alley 13 3/4 rods; thence South 11 rods and 10 1/2 feet; thence West 13 3/4 rods to the place of beginning, and containing 1 acre of land more or less. NOW, THEREFORE, BE IT ORDAINED, BY THE TOWN COUNCIL OF THE TOWN OF SILVER LAKE, INDIANA AS FOLLOWS: Section 1. The following described real estate situate in Kosciusko County, State of Indiana, being contiguous with the existing corporate boundaries of the Town of Silver Lake, Indiana, is now hereby annexed to and made a part of the Town of Silver Lake, Indiana, and which real estate is described on "Exhibit 1' attached hereto and made a part hereof. Section 2. This Ordinance shall be in full force and effect upon its adoption and shall become effective thirty (30) days after its publication and recording as required by Indiana Code 36-4-3-7 and Indiana Code 36-4-3-22.
