AN ORDINANCE PROHIBITING SOLICITATION WITHIN
THE TOWN OF SIDNEY
    WHEREAS, the Town Council of the Town of Sidney, Indiana, has considered recent incidents and problems arising from home solicitation within the Town of Sidney; and
    WHEREAS, the Town Council has determined that it is in the best interests of the residents of the Town of Sidney, and consistent with the health, safety, and welfare of the residents of the Town, that home solicitation be prohibited within the Town Limits.
    NOW, THEREFORE BE IT ORDAINED BY THE TOWN COUNCIL OF THE TOWN OF SIDNEY, INDIANA, as follows:
    Section 1. It shall be unlawful for any person, not a resident of the Town of Sidney, Indiana, or employed by a person, firm or corporation having a residence, offices or businesses establishment located in the Town of Sidney, Indiana to sell, offer for sale, solicit order for sale or peddle any goods, wares, products, service, services or merchandise for present or future delivery with or without charge thereafter within the town limits of Sidney, Indiana.
    Section 2: The prohibition confined in Section 1 thereof shall not apply to persons who sell to merchants or dealers who make purchases of goods, wares,, products, services, or merchandise for re-sale, or to persons engaged in the delivery of daily newspapers or to any person operating a regular route or insurance debit to solicit additional customers on which route or debit when such solicitation is incidental to his regular duties, or shall the prohibition contained in Section 1 hereof apply to any not-for profit entity, group, or individual who resides or is located in, or substantially connected to, the town of Sidney, Kosciusko County, Indiana.
    Section 3. Any person authorized to sell or peddle without a license in the State of Indiana by virtue of a statute of the State of Indiana providing for such exemption shall be exempt from the provision of the Ordinance upon satisfactory proof being made to the Town Clerk-Treasure, that such applicant is so exempt.
    Section 4. Any person in violation or any of the terms or provisions of this ordinance shall, upon conviction thereof, be fined not less than Fifty Dollars ($50.00) or more than Five Hundred Dollars ($500.00) per occurrence.
    Section 5. That this ordinance shall be in full force and effect from and after its passage and publication as required by law.
