NOTICE OF HEARING Town of Pierceton Sewage Works TO: Users and Other Interested Persons of the Sewage Works of the Town of Pierceton, Indiana NOTICE IS HEREBY GIVEN that on December 8, 2014 at 6:30 p.m., at the Community Building located at 103-105 Walnut Street, Pierceton, Indiana, the Town Council of the Town of Pierceton, Indiana will hold a public hearing upon Ordinance No. 2014-11-1, which was Introduced by the Town Council on November 10, 2014, which Ordinance provides for amending, by increasing the sewage rates and charges of the users, which rates and charges are proposed, as follows: Sec. 10-2-1 Rates and Charges For the use of and the service rendered by said sewage disposal works, rates and charges shall be collected from the owners of each and every lot, parcel of real estate or building that is connected with the Town's sanitary sewerage system or otherwise discharges sanitary sewage, industrial wastes, water or other liquids either directly or indirectly into the sanitary sewerage system of the Town which rates and charges shall be payable as hereinafter provided and shall be in an amount determinable as follows: (a) Except as herein otherwise provided, sewage rates and charges shall be based on the quantity of water used on or in the property or premises subject to such rates and charges, as the same is measured by the water meter then and there in use. If a sewage meter is in use with consent of the Town Council, then for purposes of determining rates and charges, the term "Sewage Meter" shall be synonymous with "Water Meter". Water meters will be read monthly and sewage bills rendered monthly. (b) The water usage schedule on which the amount of said sewage rates and charges shall be determined for all users other than an Intergovernmental Sewage Utility, shall be as follows: Quantity of Water Charge Per Used Per Month 1,000 Gallons First 2,000 gallons $13.65 Next 4,000 gallons 8.16 Next 9,000 gallons 5.39 Next 20,000 gallons 4.77 Next 45,000 gallons 4.09 All Over 80,000 gallons 3.43 The minimum charge for any user per month shall be based upon meter sizes as follows: Minimum Charge 5/8 inch water meter $27.30 1 inch water meter 46.75 1 1/4 inch water meter 66.80 1 1/2 inch water meter 93.50 2 inch water meter 113.55 2 1/2 inch water meter 133.55 3 inch water meter 160.00 4 inch water meter 226.95 6 inch water meter 340.35 In no event shall the minimum charge be less than Twenty-Seven Dollars and Thirty Cents ($27.30) per month. The above rates and charges will apply except as otherwise provided herein or by other ordinance. (c) The Sewage Usage Schedule on which the amount of rates and charges for an Intergovernmental Sewage Utility user shall be as follows: Charge Per $1,000 Gallons All over 1 Gallon $1.70 (d) For the service rendered to the Town of Pierceton said Town shall be subject to the same rates and charges as herein above provided. (e) An Intergovernmental Sewage Utility is a sewage utility operated by another Governmental unit. (f)) Out of Town Rates: Except for the Intergovernmental Sewage Utility, the rates for service to property in Town and for the service to property outside of Town Boundaries are the same, therefore the rates are not different. The Intergovernmental Sewage Utility rate is less than the in-Town rates. Ordinance numbered 87-9-3 of the Town of Pierceton, Indiana, adopted on October 1, 1987, and Ordinance No. 88-9-1 adopted October 10, 1988 shall continue in full force and effect and is not modified or amended by this Ordinance. Any user of the Town of Pierceton, Indiana Waterworks, any owner of property served or to be served by the Waterworks, and any other persons, may appear at said hearing and be heard. Comments may be submitted in writing in advance of the hearing by delivering them to the Clerk Treasurer of the Town at 103-105 Walnut Street, Pierceton, Indiana and those comments will be considered at the hearing. The hearing will be held in accordance with I.C. 8-1.5-8.1, and may be adjourned and continued. Rights of objectors exist as are provided for by I.C. 8-1.5-3-8.2. After the hearing, the municipal legislative body shall adopt the ordinance establishing the rates and charges, either as originally introduced or as modified. A copy of the schedule of rates and charges adopted shall be kept on file and available for public inspection in the offices of the board (Town Council) and the municipal clerk. An ordinance adopted after March 31, 2012, that imposes different rates and charges for service to property located outside the corporate boundaries of the municipality as compared to property located within the corporate boundaries of the municipality must state in plain language the percentage difference between the rates and charges. However, the proposed ordinance does not impose different rates and charges for users, except for the Intergovernmental Sewage Utility, which rates for the Intergovernmental Sewage Utility, are less because there are certain services that Town of Pierceton does not provide. Following adoption of the ordinance the users of the works for service to property located outside the municipality's corporate boundaries may be entitled to petition the commission under IC 8-1.5-3-8.3 to review and adjust the rates and charges imposed on the users if a petition under section IC 8-1.5-3-8.2 or under IC 36-9-23-26. with respect to the same rate ordinance has not been filed.
