AN ORDINANCE OF THE TOWN OF PIERCETON, IN
ELECTING TO HAVE FIRE PROTECTION PROVIDED BY
WASHINGTON TOWNSHIP WITHOUT A CONTRACT
WHEREAS, the Town of Pierceton, Indiana is a municipality completely located within Washington Township, Kosciusko County, Indiana; and
WHEREAS, said Washington Township provides fire protection within its boundaries; and
WHEREAS, a certain contract for fire protection between the Town of Pierceton and Washington Township expires on December 31, 2024, and will not be renewed, and thereafter there will not be a contract for fire protection between the Town of Pierceton and Washington Township in effect as of January 1, 2025; and
WHEREAS, it is deemed in the best interest of the citizens of the Town to continue to have fire protection provided by Washington Township without a contract after the expiration of said contract on December 31, 2024;
THEREFORE, BE IT ORDAINED BY THE TOWN COUNCIL OF THE TOWN OF PIERCETON, INDIANA THAT:
SECTION 1. Pursuant to IC 36-8-13-3(b)(l), the Town of Pierceton hereby elects to have Washington Township provide fire services within the Town's boundaries without a contract beginning January 1, 2025.
SECTION 2. However, the Town Council shall retain authority to continue to contract for fire protection services should Washington Township fail to pass a resolution approving the provision of the fire protection services without a contract with the Town prior to July 1 , 2024.
SECTION 3. This Ordinance shall be effective upon its passage and shall be filed with the Auditor of Kosciusko County. Further, this Ordinance shall be published in the Warsaw Times-Union, a newspaper of general circulation published daily in Warsaw, Kosciusko County and circulated in Pierceton.
Upon Motion Duly Made, this Ordinance was Adopted by the Town Council of the Town of Pierceton, Indiana on the 12th day of February, 2024, by a vote of 3 aye's and 0 Nay's
