ORDINANCE NO. 12-425 AN ORDINANCE ANNEXING CERTAIN TERRITORY TO T HE TOWN OF MENTONE, INDIANA WHEREAS, the Town Council of the Town of Mentone, Indiana, has determined that the annexation of certain real estate to the Town of Mentone is in the it best interests of the residents and property owners in the area to be annexed, and that the real estate should be annexed to the Town of Mentone Indiana; and, WHEREAS, said real estate is owned by a business entity, and is contiguous with the existing boundary of the Town of Mentone, Indiana as defined by Indiana Code 36-4- 3-l.5; and, WHEREAS, the real estate to be annexed is described on "Exhibit 1" attached to this Ordinance and made a part hereof EXHIBIT 1 A Tract of land in the Southwest Quarter of the Northwest Quarter of Section 1, Township 31 North, Range 4 East, more particularly described as follows, to-wit: Beginning at a point on the East right-of-way line of State Road Number 19, said point being 20 feet East and 100 feet North of the Southwest comer of the Northwest Quarter of said Section 1, Township and Range aforesaid and running thence East 180 feet to a stake; thence South 100 feet to a fence line; thence East 73.4 feet along said fence line; North 1 degree 28 minutes West 432.6 feet along a barb wire fence to a stake; thence West 243.1 feet to the East line of State Road Number 19; thence South 323.4 feet along the East line of State Road Number 19 to the Place of Beginning, LESS AND EXCEPTING THEREFROM THE FOLLOWING: A tract of land in the Southwest Quarter of the Northwest Quarter of Section 1, Township 31 North, Range 4 East, described as follows: Beginning at a point on the East right-of- way line of State Road Number 19, said point being 20 feet East and 100 feet North of the Southwest comer of the Northwest Quarter of said Section, Township and Range aforesaid, and running thence East 180 feet to a stake; thence South 100 feet to a fence line; thence East 73.4 feet along said fence line; thence North 1 degree 28 minutes West 250 feet along a barb wire fence to a stake; thence West 243.1 feet to the East line of State Road Number 19; thence South 150 feet along said East line of State Road Number 19 to the Place of Beginning. Subject to any and all easements, rights-of-way, streets, highways and valid restrictions presently existing and of record, any rights of tile and drainage ditches, and any zoning ordinances applicable hereto. NOW THEREFORE, BE IT ORDAINED BY THE TOWN COUNCIL OF THE TOWN OF MENTONE, INDIANA AS FOLLOWS: SECTION 1. The real estate is situated in Kosciusko County, State of Indiana, being contiguous with the existing corporate boundaries of the Town of Mentone, Indiana, is hereby annexed to and made a part of the Town of Mentone, Indiana and which territory is described on "Exhibit 1" attached hereto and made a part hereof. SECTION 2. This Ordinance shall be in full force and effect upon its adoption and shall become effective ninety (90) days after its publication and recording as required by Indiana Code 36-4-3-7 and Indiana Code 36-4-3-22 .
