LAW ENFORCEMENT RECORDS AND LAW ENFORCEMENT RECORDINGS
WHEREAS, Indiana Code Section 5-14-3-8, as may be hereinafter amended., allows a public agency to charge a fee for providing a duplicate of a computer tape, computer disc, microfilm, law enforcement recording, or similar or analogous record system containing information owned by the public agency or entrusted to it; and
WHEREAS, The Town of Claypool has determined that it would be appropriate to establish a fee schedule for the provision of such law enforcement records and law enforcement recordings; and
WHEREAS, Indiana Code Section 5-14-3-8, as may be hereinafter amended, authorizes any such fees collected for the copying of a law enforcement recording to be retained by the public agency and used without appropriation to purchase cameras and other equipment for use in connection with the agency's law enforcement recording program, for training concerning law enforcement recording, or to defray the expenses of storing, producing, and copying law enforcement recordings, without such fees reverting to the local general fund at the end of a fiscal year; and
WHEREAS, The Town of Claypool has determined that it is necessary to establish an additional budget account to hold funds collected as such fees;
NOW, THEREFORE, BE IT ORDAINED by the Town Council of the Town of Claypool, Indiana:
Section 1. In accordance with Indiana Code Section 5-14-3-8, as may be hereinafter amended, the Town of Claypool, Town Marshal's Office shall charge the following fees for law enforcement records and law enforcement recordings:
a. Reports shall !be fifteen dollars ($15.00) each;
b. Photographs shall be fifty-five dollars ($55.00) for each incident (and shall include all photographs of that particular incident); and
c. Law Enforcement Recordings shall be one hundred fifty dollars ($150.00) each.
Section 2. The person or party requesting law enforcement recordings shall provide a written request to the Town Marshal's Office using a request form made available by the Town Marshal's Office.
Section 3. An additional budget account is now hereby created, which shall be known as the Claypool Law Enforcement Recording Fees Fund, into which fund any fees or revenues collected as a result of copying or providing law enforcement records and law enforcement recordings shall be held and utilized, without appropriation, to fund the law enforcement needs of the Town of Claypool, in accordance with and as authorized by Indiana Code Section 5-14-3-8, as may be hereinafter amended, and which fees shall not revert back to the general fund at the end of the fiscal year.
THIS ORDINANCE shall be in full force and effect from and after it passage. Passed and adopted by The Town Council of of the Town of Claypool, Indiana this 20th day of November, 2018.
