NOTICE  OF HEARING ON PROPOSED RATES AND CHARGES
FOR THE TOWN OF CLAYPOOL, INDIANA
Property owners, rate payers and other .interested parties in, served by or to be served by the Town Of Claypool, Indiana are hereby notified that Ordinance No. 2023-7-1, establishing rates and charges for services to be rendered by the sewage works, was introduced at the regularly scheduled meeting of the Town Council for the Town held on July 18, 2023. At a meeting of the Town Of Claypool , Indiana to be held at 7:00 PM on Tuesday, August 15, 2023 at the Claypool Lions Club, Meeting Room, 201 W Calhoun St, Claypool, IN 46510 there will be a public hearing on the matter of t he rates and charges, and consideration of adoption of said Ordinance No. 2023-7-1, which provides in pmt as follows:
Section 1.
That Article One of Ordinance 1999-3-1 is hereby repealed, revoked and rendered null and void.
Section 2.
That Section 2 of Ordinance 2011-3-1 is hereby repealed, revoked and rendered null and void.
Section 3.
That Section 2 of Ordinance 20 I 1-4-1 is hereby repeal ed, revoked and rendered null and void.
Section 4.
That Article One of Ordinance 1 999-3-1 is hereby modified a nd changed, and the rates and charges for base rates per month arc as follows for metered users:

Section 5.
That Section 2 of Ordinance 2011-4-1 is hereby modified and changed, and the rates and charges for the base rates per month are as follows for unmetered users:
Residential:
Single family dwelling unit (per month) $73.32
Section 6.
That Section 2 of Ordinance 2011-3-1 is hereby modified and changed, as follows:
That no charge shall be assessed other than the base rates for flows of water used each month less than one thousand gallons. That in addition to the base rate, charges will be assessed for How rates of water used in excess of one thousand gallons per month for user charges in the amount of Four Dollars and Fifty-Eight Cents ($4.58) per thousand gallons. These charges will be pro-rated and assessed based upon the per gallon flow of water used for each user each month.
Section 7.
This Ordinance shall supersede the applicable provisions of Ordinance Number 1999-l-3, Ordinance Number 2011-3-1, and Ordinance Number 2011-4-1 when it becomes effective, and this Ordinance shall be in full force and effect from and after its passage and after due publication as provided by law. Those provisions of Ordinance Number 1999-1-3, Ordinance Number 2011-3-l, and Ordinance Number 2011-4-1 that are not modified by this Ordinance shall remain in full force and effect.
At the August 15, 2023 Public Hearing and prior to final adoption of Ordinance No. 2023-7-1 any property owners, ratepayers, or anyone else interested in the proceedings may appear and be heard concerning the proposed rates and charges. A complete copy of the Ordinance ma y be reviewed at the Town Of ClaypooL Indiana Office located at 408 S. Graceland Ave., Claypool, IN 46510.
Following the adoption of Ordinance No. 2023-7-1 , users located outside District's boundaries may be entitled to petition the Indiana Utility Regulatory Commission under Section 8-1.5-3 to review
and adjust the rates and charges imposed on the users if a petition under section 8-1.5-3 or under IC 36-9-23-26.1 with respect to the same rate ordinance has not been filed.
